POLICY ON THE PROCESSING OF PERSONAL DATA CUSTOMERS AND SUPPLIERS EU Reg 2016/679 and It. Leg. Decree No. 101/2018

In relation to the processing of personal data provided please be informed that:

1. Data Controller

The Data Controller is the company Airplast S.r.l.,  VAT No. 03157090238, , with registered office at Via Piave 8 - 36066 Sandrigo (VI), Italy, Tel. No. +39 0444.461000, e-mail privacy@airplast.it, certified email: certificata@pec.airplast.it (hereinafter for the sake of brevity “the Company”).

2. Type of data processed, Processing purpose and legal basis

The following personal data is collected and processed: personal data of a common nature (company name, first name, last name, master data, role within the company, address, VAT number, tax code, bank data, master data and contact data: e-mail, telephone, cell phone number), referring to: companies/organisations, customers and suppliers and contacts-employees-associates-subcontractors of customers/suppliers, possibly communicated by the same, for (a) pre-contractual purposes and execution of the contractual relationship; (b) administrative-accounting-tax related and legal obligations relating to billing and management of the contractual relationship; (c) sending of commercial-promotional-marketing-invitation communications related to the products supplied and forwarding to trade fairs and events, carried out by e-mail or sms or telephone.

Legal basis for data processing: fulfillment of contractual obligations for the purposes mentioned in (a); legal obligations, for the purposes mentioned in (b); legitimate interest of the Data Controller for the purposes mentioned in (c), as this is an activity carried out on contacts related to contractual activities with legal persons.

3. Communication of data to third parties - Data recipients

The Company may disclose the data processed for the above purposes to: internal company parties in charge of processing; external parties belonging to the following categories: external consultants, service companies (transportation, shipping, marketing and IT service companies), the company's sales network (agents), banking institutions, supervisory bodies and entities.

4. Transfer of personal data to third countries

No processed data is transferred by the Data Controller to third countries. However, in the event of transfer of data to third countries, the same will take place in compliance with the legislation in force from time to time regarding the transfer of data to third countries.

5. Processing methods, data retention period and criteria

The data will be processed in hard copy and digital form. The data will be processed by the Data Controller for the period necessary for the execution of the above-mentioned purpose(s) and on conclusion of them for the additional legally prescribed period related to the retention of contracts and administrative data and/or for defense in court (ten years from the last use and/or event interrupting the prescription).

6. Profiling and automated decision-making processes

Processing is not carried out through automated decision-making processes (e.g. profiling).

7. Provision of data

The provision of data is mandatory for the execution of the contractual relationship (2.a.) and legal purposes (2.b.) while it is optional for marketing purposes (2.c.), the data subject being able to object to the processing as indicated below. Failure to provide data will make it impossible to pursue the above-mentioned purposes.

8. Rights of the data subject, Withdrawal of Consent and Complaint to the Data Protection Authority

Data subjects have the right, at any time, to request: access to their personal data, rectification, deletion, and restriction of the same, the right to object to the processing, to revoke the consent given, and to exercise the right to data portability, where applicable, by contacting the Data Controller as indicated below.

In the event of alleged violation, the data subject, in the presence of the necessary conditions, also has the right to lodge a complaint with a Data Protection Authority situated in the EU Member State where they normally reside or in the EU State in which they work or in which the violation took place.
